are holding the fire and waiting. do we have bill daily standing by? let's go to former f.b.i. investigator bill daily. i want to get your take on what is going on here. they are not firing. you know, you did some yeoman's work for us when it came to the mind set of the person who is holding the 5-year-old boy in a bunker for a week. now what is going on inside the cabin, christopher dorner, he stopped firing and he is sitting there and he knows he is surrounded. what is the next move on his behalf and on, or on his part and the police officers' behalf? >> start from the police perspective, they are trying to make sure that no civil yaps are within the range of where flying bullets may harm them. they want to make sure the police officers are also protected, and don't have as will of life that could be involved in taking him perhaps alive. we are going to make sure that we bring in tactical unit so as they corden off the area they bring the tactical swat teams in, up and close because they provide the technology and the skill craft to be able to, if they need to, go in the cabin or provide

astonishing. what is the administration explanation for the fact that the fbi interviewed the is survivors, all of the americans who safely got out of benghazi after the attack months ago and they refuse to give the transcripts of the interviews to congress? what is their explanation for that? >> this is an ongoing criminal investigation is what they told me. we are going back to the law enforcement model where we are treating al-qaeda as sort of a mafia common criminal element rather than enemy combatants. here is what was really stunning. the fbi interviewed the survivors two days after the attack in germany and the cia never called the fbi for weeks wanting the results of the interview before they made their assessments. we are going back to the pre9/11 mentality of where we treat this as a law enforcement function and the fbi and cia never talked to each other which is dangerous. benghazi was system failure before, during and after. >> chris: senate republicans also talking about holding up the nomination of john brennan the president's chief counter terrorism advisor to head the cia a

. nbc's john yang is in our los angeles bureau, but let's go to former fbi profiler clint van zandt who has been watching this. he's on the phone. clint, what are we looking at here? it seems the evidence we have is he broke into a house in the san bernardino mountains, tied up two of the people who lived there, stole their pickup truck and is now trying to get away from police. >> yeah. it may be that's exactly the case. realize, chris, that's one of the scenarios that law enforcement had to the consider. as you know, up in those mountains where they've conducted this massive manhunt, there are literally hundreds of private homes and cottages, some that are occupied and some that aren't. police believe they had done a house-by-house search, but somehow in one of those residences it appear that is dorner had managed to break in, held two people hostage for over an extended period of time, and now perhaps with one hostage attempted to make a break to escape from that area. there are media reports that suggest a vehicle he's driving, a pickup truck, has been wrecked or otherwise run off t

. the fbi, marshal service, and other state and federal agencies. but again, i would think that longs the sheriff's office was comfortable, that they had both the negotiations as well as the tactical capability to resolve it, they would take the lead and they would be the one to resolve the situation. backed up and supported by all the men and women of other agencies as well as equipment. as far as any type of air assets, other than having the helicopter up on the offchance the shooter inside that cabin would make a break for it, i doubt we would see any type of helicopters used to bring tactical officers or agents in at this point. they can deal with it from the ground. these are the situations that law enforcement is trained to deal with. local s.w.a.t. is very good at these things. and i think well within the capability of the sheriff's office to deal with this barricaded situation. for a long time law enforcement went this last week or so many times have been out-gunned by a person believed to be christopher dorner because of the high caliber of perhaps weapon capacity he's had. w
